Stillwater, Minnesota — A Minnesota man was found guilty on all counts, and authorities are searching for him after he failed to appear in court for his trial on Monday.
David Powers, of New Auburn, was charged with first-degree criminal sexual conduct, kidnapping, and domestic assault by strangulation.
He had been present on previous days of his trial, but he did not appear on Monday, when he was scheduled to be cross-examined. The Washington County Attorney stated that Powers’ lawyer has no idea where he is.
“Powers will be arrested and brought back to court, and I intend to request a significant upward departure from the presumptive sentence under the Minnesota Sentencing Guidelines,” County Attorney Kevin Magnuson said in a statement.
“This office places a high priority on prosecuting predators engaged in these types of violent offences and ensuring the safety of the public.”
The case dates back to 2023, when deputies were called to an apartment in Lake Elmo for a welfare check after a woman failed to show up for work.
According to the criminal complaint, when deputies arrived, the woman was screaming for help, and they had to use force to enter the apartment. The victim reportedly suffered serious injuries to her neck, forearm, and hands. Magnuson described the allegations at the time as “deeply disturbing and horrific.”
The Washington County Sheriff’s Office confirmed to KARE 11 on Tuesday that they are actively searching for Powers.
