Key Provisions of the Law

  1. Prohibited Restraints:
    • Chains or restraints with weights attached are banned.
    • Restraints must be at least 10 feet long or five times the length of the dog (measured from nose to tail).
    • Collars or harnesses must be properly fitted and designed specifically for dogs.
  2. Required Conditions:
    • Dogs left outside must have access to:
      • Adequate shelter that protects them from extreme weather (heat, cold, rain, hail, etc.).
      • Shade from direct sunlight.
      • Potable drinking water.
      • An area free of standing water and excessive waste.
  3. Exceptions:
    • Temporary restraints during activities like camping or training are allowed.
    • Restraints are permitted during agricultural work or herding livestock.

Penalties for Violations

  • Violating the law can result in a Class C misdemeanor, punishable by a fine of up to $500.
  • Repeat offenders may face a Class B misdemeanor, which carries a fine of up to $2,000 and/or up to 180 days in jail.

Elimination of the Warning Period

Previously, law enforcement had to provide a 24-hour warning before taking action against violations. The new law eliminates this waiting period, allowing authorities to intervene immediately in cases of inhumane conditions.
